1. Our Commitment
At Destinos, we pride ourselves on being a friendly, caring, and client-focused company. We value clear communication, mutual respect, and professionalism in all interactions. We appreciate working with clients who approach us with the same courtesy and collaborative spirit.
2. Hosting & DNS Responsibilities
- Clients who host their website with Destinos but manage email elsewhere are responsible for all DNS changes required for email functionality.
- Destinos cannot be held liable for misconfigurations or delays in DNS updates made by third-party providers.
- If DNS changes are requested and not completed within 7 calendar days, Destinos is not responsible for any resulting downtime, email disruption, or service interruption.
- Clients must ensure their domain provider promptly applies necessary DNS changes to avoid service degradation.
3. Domain Name Services
- Destinos provides domain registration, renewal, and management services for clients who opt to host their domain with us.
- Clients who register their domain elsewhere are responsible for managing DNS settings and ensuring proper configuration.
- Destinos is not responsible for domains that are not renewed on time. Once a domain enters redemption, additional fees apply, and recovery is not guaranteed.
- Payment for renewal must be received at least 7 days before expiration to ensure uninterrupted service.
4. Server Migration
- Websites may be moved to a new server for performance, security, or operational efficiency.
- Clients who host both website and email with Destinos will not be affected.
- Clients who host email externally may experience downtime if DNS records are not updated in time.
5. Billing & Service Requests
- Services are billed at the current hourly rate.
- Minimum billable time is 15 minutes per request.
- Clear instructions from the client help minimize billed time.
- Scheduled appointments, consultations, or onboarding sessions are billable.
- Cancellations with less than 24 hours’ notice may incur a minimum charge.
6. Backup & Data Protection
- Daily backups are performed for hosted websites.
- Backups are stored securely on a separate server.
- Restoration is available upon request and billed at the standard hourly rate.
7. Support & Response Times
- Standard support hours: Monday – Friday, 9 AM – 5 PM (SAST).
- Emergency support is available for critical issues affecting website functionality.
8. Liability & Limitations
- Destinos is not responsible for third-party service failures, including domain registrars, email providers, or external integrations.
- Destinos is not liable for financial losses due to downtime caused by client-side misconfigurations or delays in DNS updates.
- Clients are responsible for ensuring their infrastructure (including DNS, email, and third-party plugins) is correctly configured and maintained.
9. Indemnity
Clients agree to indemnify and hold Destinos harmless from any claims, damages, or losses arising from:
- Misuse of services
- Third-party disputes
- Regulatory violations
- Failure to act on technical recommendations or DNS instructions within the specified timeframe
10. Force Majeure
Destinos shall not be held liable for service interruptions caused by events beyond its reasonable control, including but not limited to:
- Acts of God
- Civil unrest
- Infrastructure failures
- Load shedding or national connectivity disruptions
11. POPIA & Data Compliance
Destinos are registered, listed and complies with the Protection of Personal Information Act (POPIA) and ensures secure handling of client data.
- Clients are responsible for ensuring their own compliance when collecting or storing user data.
- Destinos provides hosting infrastructure that may store end-user personal data on behalf of clients. Destinos does not access, process, or use this data unless explicitly agreed upon in writing. Clients are solely responsible for ensuring their own compliance with POPIA and other applicable data protection laws.
- Additional Consent for New Processing Purposes
If Destinos intends to process personal information for any purpose beyond what was originally specified—such as analytics, case studies, or other lawful uses—we will obtain explicit, informed consent from the data subject before proceeding. Clients may decline or withdraw such consent at any time.
12. Termination & Refunds
- Services may be terminated with 30 days’ written notice.
- Refunds are not guaranteed and will be assessed based on work completed and costs incurred.
- Any prepaid services forfeited due to early termination are non-refundable unless otherwise agreed.
13. Agreement Updates
This SLA may be updated periodically to reflect changes in service offerings.
- Clients will be notified of any updates before they take effect.

2. Hosting Environment Changes
- We reserve the right to change the hosting environment at our sole discretion.
- Changes will be made on a like-for-like basis and will not affect your use of the hosting environment.
- Changes may be necessary:
- To comply with laws, regulatory requirements, and industry standards.
- To implement technical improvements, such as security enhancements.
- If we do not manage your domain name, we cannot update your A records during migrations.
- We will notify your company’s IT Administrator, requesting them to contact the appropriate parties responsible for managing these records.
3. Payments & Billing
- Domain Names: Renewable annually. Failure to pay the renewal fee may result in domain loss.
- Hosting: Payable monthly in advance.
- Design & Development: Billed at an hourly rate, with a minimum of 15-minute increments.
- Maintenance & Additional Services:
- Content and system maintenance can be ordered as needed or on a monthly basis.
- Charges depend on the chosen frequency (weekly, twice a month, or monthly).
- Any maintenance post-installation is billed at R650/hour, in 15-minute increments.
- Payment Methods: Payments can be made via Paystack or manual EFT, based on client preference.
4. Intellectual Property & Copyright
- All designs, code, and content on the Site remain the property of Destinos, unless otherwise agreed in writing.
- Unauthorized use, reproduction, or distribution of our intellectual property is strictly prohibited.
5. Liability & Limitations
- Destinos is not responsible for third-party service failures, including domain registrars, email providers, or external integrations.
- Destinos is not liable for financial losses due to downtime caused by client-side misconfigurations.
- Destinos is not responsible for domains that are not renewed on time. Once a domain enters redemption, additional fees apply, and recovery is not guaranteed.
